These Terms and Conditions ("Terms") govern the provision of truck rental and transport services by Talbot Transport ("the Company", "we", "us", or "our") to any client, customer, or user ("the Customer", "you", or "your"). By booking, hiring, or using our services or equipment, you agree to be bound by these Terms.

2. Scope of Services
Talbot Transport provides truck rental, trailer rental, and transport services primarily for mining and agricultural purposes, including but not limited to the transportation of minerals (such as copper, coal, and chrome), grain, soil, and related materials.
Services are provided subject to availability and acceptance by the Company.
3. Booking and Acceptance
3.1 All bookings are subject to confirmation by Talbot Transport.
3.2 We reserve the right to refuse any booking at our discretion.
3.3 Any changes or cancellations must be communicated as early as possible and may be subject to cancellation fees.
4. Rental Period
4.1 The rental period begins when the vehicle or equipment is delivered to or collected by the Customer and ends when it is returned to Talbot Transport in acceptable condition.
4.2 Late returns may incur additional charges.
5. Customer Obligations
The Customer agrees to:

Use vehicles and equipment only for their intended purpose

Comply with all applicable laws, regulations, and safety standards

Ensure that only authorized and legally licensed drivers operate the vehicles

Not overload vehicles or trailers beyond legal or manufacturer limits

Take reasonable care of all rented vehicles and equipment
6. Payment Terms
6.1 All fees are agreed upon prior to commencement of services unless otherwise stated in writing.
6.2 Payment terms may include deposits, advance payments, or payment upon completion, as agreed.
6.3 Late payments may attract interest or penalties.
7. Fuel, Tolls, and Operating Costs
Unless otherwise agreed in writing:

Fuel costs are the responsibility of the Customer

Tolls, permits, and related charges are for the Customer’s account
8. Damage, Loss, and Repairs
8.1 The Customer is responsible for any loss of or damage to vehicles, trailers, or equipment during the rental period, excluding fair wear and tear.
8.2 The Customer shall be liable for repair costs, replacement costs, and any associated downtime losses.
9. Insurance and Liability
9.1 Talbot Transport may maintain insurance coverage as required by law.
9.2 The Customer remains liable for any excess, uninsured losses, negligence, misuse, or unlawful operation.
9.3 Talbot Transport shall not be liable for indirect, incidental, or consequential losses, including loss of profit or business interruption.
10. Indemnity
The Customer agrees to indemnify and hold harmless Talbot Transport from any claims, damages, losses, fines, or expenses arising from:

Misuse of vehicles or equipment

Breach of these Terms

Violation of laws or regulations
11. Delays and Force Majeure
Talbot Transport shall not be held liable for delays or failure to perform due to circumstances beyond our reasonable control, including but not limited to weather conditions, mechanical failure, strikes, accidents, or acts of God.
12. Termination
We reserve the right to terminate services immediately if the Customer breaches these Terms or uses vehicles or equipment in an unsafe or unlawful manner.
13. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the applicable jurisdiction in which Talbot Transport operates.
14. Amendments
Talbot Transport reserves the right to amend these Terms at any time. Updated Terms will apply to all future bookings.
15. Acceptance
By engaging Talbot Transport’s services, the Customer acknowledges that they have read, understood, and agreed to these Terms and Conditions.
